FACTS OF THE CASE:

Rahimi was convicted of possessing a gun while under a domestic violence protective order. Thus, he challenged the order as a violation of his right to bear arms. The U.S. Court of Appeals for the Fifth Circuit, in return, asserted that individuals under such orders have a constitutional right to possess guns as the historical analogues did not support restricting gun rights for those with protective orders.

The ACLU, on the other hand, disagrees and argues that this reasoning risks hindering the government's ability to address new threats. It calls for a rejection of the Fifth Circuit's rationale and suggests narrower grounds that the Second Amendment right to bear arms are limited to "law-abiding, responsible citizens."
